Qu\u2019est-ce qu\u2019un fonds de pr\u00e9voyance?<\/strong><\/p>\n\n\n\n<p>Le fonds de pr\u00e9voyance est une r\u00e9serve mon\u00e9taire qui permet de financer la r\u00e9alisation de r\u00e9novations et de travaux majeurs \u00e0 court, moyen et long terme dans les parties communes d\u2019une copropri\u00e9t\u00e9<a href=\"https:\/\/www.centris.ca\/#_ftn1\">[1]<\/a>. Celui-ci doit \u00eatre en partie liquide, disponible \u00e0 court terme et son capital doit \u00eatre garanti<a href=\"https:\/\/www.centris.ca\/#_ftn2\">[2]<\/a>. Il s\u2019agit donc d\u2019un moyen collectif de maintenir l\u2019immeuble en bonne condition en \u00e9vitant aux copropri\u00e9taires d\u2019avoir \u00e0 d\u00e9bourser une cotisation sp\u00e9ciale pour des travaux urgents, ce qui pourrait compromettre leur situation financi\u00e8re personnelle.<\/p>\n\n\n\n<p>En vigueur depuis le&nbsp;<a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/ccq-1991\"><em>Code civil du Qu\u00e9bec<\/em><\/a>&nbsp;de 1994, cette obligation vise d\u2019abord et avant tout \u00e0 combler le manque d\u2019encadrement financier qui avait p\u00e9nalis\u00e9 de nombreux copropri\u00e9taires pour lesquels le syndicat de copropri\u00e9t\u00e9 n\u2019accumulait pas une r\u00e9serve de fonds suffisante pour r\u00e9pondre ad\u00e9quatement aux besoins d\u2019entretien de l\u2019immeuble.<a href=\"https:\/\/www.centris.ca\/#_ftn3\">[3]<\/a><\/p>\n\n\n\n<p><strong>2. Comment d\u00e9terminer \u00e0 quoi servira le fonds de pr\u00e9voyance?<\/strong><\/p>\n\n\n\n<p>Afin d\u2019identifier les travaux qui pourront \u00eatre r\u00e9alis\u00e9s \u00e0 partir du fonds de pr\u00e9voyance, le conseil d\u2019administration de la copropri\u00e9t\u00e9 devra examiner la&nbsp;<a href=\"https:\/\/www.centris.ca\/fr\/blogue\/immobilier\/copropriete-divise-ce-que-vous-devez-savoir\">d\u00e9claration de copropri\u00e9t\u00e9<\/a>&nbsp;qui \u00e9nonce, entre autres, les parties communes de l\u2019immeuble.<\/p>\n\n\n\n<p>Les r\u00e9parations majeures devront, quant \u00e0 elles, porter sur \u00ab&nbsp;une partie importante du bien et n\u00e9cessiter une d\u00e9pense exceptionnelle&nbsp;\u00bb, comme le stipule le&nbsp;<em>Code civil du Qu\u00e9bec<\/em>. Elles pourraient donc cibler<a href=\"https:\/\/www.centris.ca\/#_ftn4\">[4]<\/a>&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Les poutres, les murs portants et le toit<\/li><li>Les portes, les fen\u00eatres et les balcons<\/li><li>Le rev\u00eatement ext\u00e9rieur et les goutti\u00e8res<\/li><li>Les syst\u00e8mes de chauffage, d\u2019\u00e9lectricit\u00e9 et de plomberie<\/li><li>Le remplacement de l\u2019asphalte dans le stationnement<\/li><li>La r\u00e9fection des aires communes<\/li><\/ul>\n\n\n\n<p>En r\u00e9sum\u00e9, le fonds de pr\u00e9voyance ne peut \u00eatre destin\u00e9 \u00e0 des r\u00e9parations mineures ou \u00e0 des frais d\u2019entretien. Il ne peut pas non plus servir \u00e0 payer des honoraires, \u00e0 s\u2019acquitter d\u2019un d\u00e9ficit ou \u00e0 apporter des am\u00e9liorations \u00e0 l\u2019immeuble<a href=\"https:\/\/www.centris.ca\/#_ftn5\">[5]<\/a>. Il diff\u00e8re \u00e9galement du fonds d\u2019impr\u00e9vus qui fait parfois l\u2019objet d\u2019une clause dans la d\u00e9claration de copropri\u00e9t\u00e9 et qui, comme son nom l\u2019indique, est destin\u00e9 aux d\u00e9penses impr\u00e9vues devant \u00eatre engag\u00e9es par le syndicat de copropri\u00e9t\u00e9<a href=\"https:\/\/www.centris.ca\/#_ftn6\">[6]<\/a>.<\/p>\n\n\n\n<p><strong>3. Quelle est la contribution des copropri\u00e9taires?<\/strong><\/p>\n\n\n\n<p>Comme pour toutes les autres charges communes, la contribution des copropri\u00e9taires est d\u00e9termin\u00e9e en fonction de la valeur relative de leur fraction de l\u2019immeuble. Celle-ci est g\u00e9n\u00e9ralement vers\u00e9e mensuellement, au m\u00eame moment que le paiement des autres frais de copropri\u00e9t\u00e9.<\/p>\n\n\n\n<p>Selon le&nbsp;<em>Code civil du Qu\u00e9bec<\/em>, le fonds de pr\u00e9voyance doit repr\u00e9senter au moins 5 % de la contribution aux charges communes<a href=\"https:\/\/www.centris.ca\/#_ftn7\">[7]<\/a>. Toutefois, afin d\u2019obtenir un montant r\u00e9aliste, les syndicats devront \u00e9valuer les co\u00fbts de remplacement et de r\u00e9paration des parties communes au moyen de l\u2019\u00e9tude de fonds de pr\u00e9voyance.<\/p>\n\n\n\n<p><strong>4. Qu\u2019est-ce que l\u2019\u00e9tude de fonds de pr\u00e9voyance?<\/strong><\/p>\n\n\n\n<p>Il arrive que la contribution minimale de 5&nbsp;% au fonds de pr\u00e9voyance soit insuffisante pour assurer l\u2019entretien r\u00e9el d\u2019une copropri\u00e9t\u00e9. Afin de pallier cette situation, le gouvernement du Qu\u00e9bec a adopt\u00e9 le&nbsp;<a href=\"https:\/\/xpertsource.com\/fr\/blogue\/copropriete-quoi-savoir-projets-loi-16-141\">projet de loi 16<\/a>&nbsp;qui pr\u00e9voit la r\u00e9alisation d\u2019une \u00e9tude du fonds de pr\u00e9voyance par un professionnel, tous les cinq ans<a href=\"https:\/\/www.centris.ca\/#_ftn8\">[8]<\/a>. Cet exercice a pour but d\u2019aider le syndicat de copropri\u00e9t\u00e9 \u00e0 planifier les d\u00e9penses \u00e0 venir, tout en limitant les impr\u00e9vus.<\/p>\n\n\n\n<p>Ainsi, l\u2019\u00e9tude de fonds de pr\u00e9voyance comprend<a href=\"https:\/\/www.centris.ca\/#_ftn9\">[9]<\/a>&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>L\u2019inspection visuelle des principales composantes physiques de l\u2019immeuble pour en d\u00e9terminer l\u2019\u00e9tat et la dur\u00e9e de vie.<\/li><li>La planification des travaux devant \u00eatre r\u00e9alis\u00e9s prioritairement.<\/li><li>L\u2019\u00e9valuation des co\u00fbts de r\u00e9parations des parties communes.<\/li><li>L\u2019analyse des sc\u00e9narios de contributions financi\u00e8res par l\u2019ensemble des copropri\u00e9taires.<\/li><\/ul>\n\n\n\n<p>Il s\u2019agit donc essentiellement d\u2019un exercice de planification qui permet d\u2019\u00e9tablir un plan financier \u00e0 court et \u00e0 long terme faisant l\u2019objet d\u2019un rapport d\u00e9taill\u00e9 comprenant diverses recommandations.<\/p>\n\n\n\n<p><strong>5. Quelle est la diff\u00e9rence avec les fonds d\u2019administration et d\u2019autoassurance?<\/strong><\/p>\n\n\n\n<p>Parmi les frais de copropri\u00e9t\u00e9 qui doivent \u00eatre acquitt\u00e9s, on retrouve le fonds d\u2019administration, le fonds d\u2019autoassurance et le fonds de pr\u00e9voyance. Chacun d\u2019entre eux occupe une fonction qui lui est propre<a href=\"https:\/\/www.centris.ca\/#_ftn10\">[10]<\/a>&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Le fonds d\u2019administration permet de payer les d\u00e9penses courantes, comme les frais d\u2019entretien et les t\u00e2ches administratives.<\/li><li>Le fonds d\u2019autoassurance est utilis\u00e9 uniquement en cas de r\u00e9clamation \u00e0 l\u2019assureur et sert \u00e0 payer les diff\u00e9rentes franchises.<\/li><li>Le fonds de pr\u00e9voyance, quant \u00e0 lui, est destin\u00e9 aux r\u00e9parations et aux travaux majeurs des parties communes de l\u2019immeuble.<\/li><\/ul>\n\n\n\n<p>En conclusion, le fonds de pr\u00e9voyance est un \u00e9l\u00e9ment primordial dans la gestion d\u2019une copropri\u00e9t\u00e9. En plus d\u2019\u00e9viter le d\u00e9boursement de cotisations sp\u00e9ciales en cas d\u2019urgence, celui-ci permet \u00e0 chacun des copropri\u00e9taires de profiter d\u2019une saine gestion des d\u00e9penses li\u00e9es \u00e0 son bien immobilier.
